These Terms cover use of veritycodeconsulting.com and how website inquiries work. Actual inspection/opinion work is governed by a signed Master Services Agreement and Statement of Work — not by this webpage. We do not issue Certificates of Occupancy and are not an AHJ.
1. Agreement to these Terms
These Terms of Use (“Terms”) govern your access to and use of the website located at https://veritycodeconsulting.com and any related pages, forms, or content we operate (the “Site”), offered by [PLACEHOLDER: legal entity name] doing business as Verity Code Consulting (“Verity,” “we,” “us,” or “our”).
By accessing or using the Site, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Site.
If you use the Site on behalf of a company, you represent that you have authority to bind that company, and “you” includes that company.
2. Who we are — and are not
Verity provides professional services related to independent code-compliance observation, closeout documentation, and — when separately engaged under a written contract — private completion / code-compliance opinions.
We are not a municipal or county building department, Authority Having Jurisdiction (AHJ), or public official. We do not issue Certificates of Occupancy, county certificates of compliance, building permits, or other governmental authorizations through this Site or otherwise, except to the extent a separate written contract with a political subdivision expressly provides for delegated inspection work under applicable law.
Nothing on the Site is an offer to act as your building official.
3. Informational purpose of the Site
Content on the Site is for general business information only. It is not legal advice, engineering advice, architectural advice, or a professional opinion on any specific project. Project-specific opinions are provided only under a signed engagement agreement and applicable certificate forms.
4. No client relationship from browsing or contacting us
Submitting a contact form, emailing us, or downloading materials does not create a client, contractual, or confidential relationship, except to the extent our Privacy Policy describes how we handle personal information, or except as stated in a separate written agreement signed by Verity.
We may decline any engagement for any reason, including conflicts, insurance limitations, or jurisdiction path.
5. Professional services terms control
If you engage Verity for services, the signed Master Services Agreement, Statement of Work, certificate forms, and any reliance letter control over these Terms in the event of conflict, for those services.
Website fee ranges, package descriptions, or case studies (if any) are illustrative only and not a quote.
6. Acceptable use
You agree not to:
- Use the Site in violation of law or for fraudulent purposes
- Scrape, harvest, or index the Site in a manner that overloads or harms our systems, except via ordinary search-engine crawling
- Attempt unauthorized access to our systems or other users’ data
- Upload malware or harmful code
- Misrepresent your identity or affiliation
- Use Site content to claim that Verity has issued a Certificate of Occupancy or acted as AHJ for any project
- Post or transmit unlawful, defamatory, or infringing content via Site forms
We may suspend or terminate Site access for violations.
7. Intellectual property
The Site, including text, graphics, logos (including the Verity Code Consulting name and marks), layout, and downloadable materials we provide, are owned by Verity or its licensors and protected by intellectual property laws.
You may view and print pages for your internal business evaluation of Verity. You may not copy, modify, republish, or commercially exploit Site content without our prior written consent, except for fair use or other non-waivable rights.
8. Third-party links
The Site may link to third-party sites (statutes, code organizations, news). We do not control or endorse those sites and are not responsible for their content or practices.
9. Disclaimers
THE SITE AND ITS CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, VERITY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
We do not warrant that the Site will be uninterrupted, error-free, or free of harmful components, or that Site content is complete or current for your project.
10. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, VERITY AND ITS OWNERS, EMPLOYEES, AND CONTRACTORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR BUSINESS OPPORTUNITY, ARISING FROM OR RELATED TO YOUR USE OF THE SITE, EVEN IF ADVISED OF THE POSSIBILITY.
OUR TOTAL LIABILITY FOR CLAIMS ARISING OUT OF THE SITE IS LIMITED TO FIFTY U.S. DOLLARS (US $50) or the amount you paid us (if any) solely for paid Site features in the twelve months before the claim — whichever is greater.
These limits do not apply to liability that cannot be limited under Texas law. They do not change liability caps in a signed services MSA, which govern professional services separately.
11. Indemnity
You will indemnify and hold harmless Verity from claims arising out of your misuse of the Site, your violation of these Terms, or your misuse of Site content to misrepresent Verity’s role (including representing that Verity issued a CoO or acted as AHJ), except to the extent caused by Verity’s willful misconduct.
12. Privacy
Personal information submitted through the Site is handled as described in our Privacy Policy.
13. Advertising and analytics
The Site may use analytics or advertising technologies as disclosed in the Privacy Policy. Your use of the Site constitutes acknowledgment of that disclosure. Where required, we will present cookie consent mechanisms.
14. Electronic communications
If you provide an email address, you consent to receive business communications related to your inquiry. Marketing emails (if any) will include an unsubscribe mechanism as required by law (including CAN-SPAM).
15. Governing law and venue
These Terms are governed by the laws of the State of Texas, excluding conflict-of-law rules. If a provision is unenforceable, the remainder stays in effect. These Terms plus the Privacy Policy are the entire agreement regarding Site use, and supersede prior website terms, but do not supersede signed service agreements.
